Fimerse Terms of Service

These Terms of Service ("Terms") are an agreement between you and Ozaar LLC, a US limited liability company registered in Delaware ("Fimerse", "we", "us"), governing your use of the Fimerse app and website. By creating an account or using Fimerse, you agree to these Terms. If you don't agree, don't use Fimerse.

1. What Fimerse is

Fimerse is a personal-finance app (with multi-currency support): you record and import your accounts and transactions, and Fimerse helps you understand your money with categorization, dashboards, insights, and an AI advisor. Fimerse is a software tool for organizing your own financial information. See the disclaimer in section 6.

2. Your account

You must provide an accurate email address and keep your password secure. You're responsible for activity under your account. You must be at least 16 years old (or the age of majority where you live) to use Fimerse. One person per account.

Some features (the AI advisor, insights, and statement import) require a **verified email address**. We send a verification link when you sign up; you can request a new one from within the app.

3. Pricing

Fimerse is currently free to use. AI-powered features (statement import, insights, the advisor) run under a fair-use credit allowance per account, shown in Settings, so that no single account can exhaust the service for everyone else.

We may introduce paid plans in the future. If we do, we'll announce it in advance, pricing will only ever apply prospectively (never retroactively), and you'll be able to export your data and close your account before any charge could apply. We do not collect or store any payment information today.

4. Acceptable use

You agree not to:

• upload data you don't have the right to use, or anyone else's financial statements without authority;
• attempt to break, overload, reverse-engineer, or gain unauthorized access to Fimerse or other users' data;
• use Fimerse for anything unlawful, or to abuse the AI features (e.g. automated scraping or attempts to extract the underlying models or prompts);
• deliberately pollute shared features (such as the community merchant-category dictionary) with false or abusive entries;
• resell or redistribute the service without our permission.

We use rate limits and other safeguards; abusing them or the AI endpoints may lead to suspension.

5. Your data

Your financial data is yours. Our handling of it is described in the Privacy Policy (PRIVACY.md), which is part of these Terms. You can export, clear, or fully delete your data from within the app at any time.

6. Not financial advice

**Fimerse is not a financial adviser, and nothing in the app, including AI-generated insights and advisor replies, is financial, investment, tax, accounting, or legal advice.** The AI can be wrong or incomplete, and figures depend on the data you enter or import. Fimerse is a tool to help you organize and think about your own money; decisions you make are your own. Consult a qualified professional before making financial decisions.

7. Availability

We aim to keep Fimerse available and reliable but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features. We keep backups but you are responsible for your own records; export your data if you need an independent copy.

8. Termination

You may stop using Fimerse and delete your account at any time. We may suspend or terminate your account if you materially breach these Terms (for example, the acceptable-use rules) or as required by law. On termination, your right to use Fimerse ends; data handling on deletion is covered by the Privacy Policy.

9. Disclaimers and limitation of liability

Fimerse is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law, including any warranty of merchantability, fitness for a particular purpose, or accuracy of AI output.

To the fullest extent permitted by law, Ozaar LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from financial decisions made using Fimerse. Our total liability for any claim relating to Fimerse is limited to the greater of US $50 or the amount you paid us in the twelve months before the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you (for example, consumer-protection rights in the EU/UK).

10. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the courts located in Delaware, except that if you are a consumer in a jurisdiction whose law gives you the right to sue, or be sued, in your local courts (such as the EU/UK), that right is unaffected.

11. Changes to these Terms

We may update these Terms; we'll change the "Last updated" date and, for material changes, notify you by email or in the app. Continuing to use Fimerse after a change means you accept the updated Terms.
